9Pass

Terms & conditions

The rules for using a stamp card, and who owes what.

1. What this is, and who you are contracting with

9Pass is a digital stamp card that lives in your phone's wallet. You register once at the shop, your card is added to your phone, and you then collect stamps when a staff member scans your card code in the shop's app. You do not install anything, on iPhone or on Android.

To reach us: nine9pass@gmail.com.

They cover your card and this website. What you buy from the shop is not part of them: the visit, the order, the price, and the reward when it is handed over are all between you and the shop.

The service is free to you. The shop subscribes and pays. We take nothing from you.

These terms are not accepted by browsing. You accept them when you press the sign-in button on the join screen, which is the button that forms the contract. When you register with Google or Apple we record that you accepted, when, and which version of this text.

2. Who owes what

The shop owns the reward. The card is the shop's offer. It alone decides what the reward is, what earns a stamp, and when and where it is handed over.

We provide the technology: we record your stamps, issue your wallet card, and show you your balance. We are not the seller of the reward, we take no payment from you, and we are not the shop's agent, partner or guarantor.

We do not promise on the shop's behalf that it will hand over the reward, because a promise like that would make us answerable for its refusal, and that is neither what we sell nor what you are getting.

But we do not leave you with nothing. We require every shop, as a condition of using 9Pass, to honour a card completed on its own published terms, and that requirement is made for the benefit of the customer who completed it. If a shop refuses you, write to nine9pass@gmail.com: we will send you the balance we hold and the reward terms as they stood when you earned them, and we will take it up with the shop.

What we owe you, and genuinely do owe: to keep the stamp balance we hold as an accurate record of what happened, to take reasonable care that your card works and refreshes itself, and to put right an error of ours once we know about it.

A shop's staff work for the shop, not for us. If one refuses a stamp or a reward, that is the shop's act.

3. Your card

You get a card by signing in with Google or Apple on the shop's join screen. Each shop has its own card with its own balance.

Your account is yours. Do not share it: whoever opens your phone sees your card and can redeem your reward.

You may delete your account and your cards whenever you like, from your card page. Your stamps and rewards are then destroyed and do not come back.

4. Earning stamps

You earn a stamp when a staff member scans your card code in the shop's app.

There are limits the shop cannot change: five minutes between stamps, and two stamps in one Riyadh day. They exist to stop a stamp being taken over and over in a single visit, not to stop you.

The shop decides what earns a stamp. We do not know what you bought or what you paid: the system does not see the shop's sales at all.

If a stamp you earned is missing, ask a staff member to add it. The shop can add one by hand.

5. Stamps are not money

A stamp is a mark of a visit. It has no monetary value.

It cannot be cashed, sold, gifted, or moved from one person to another or from one shop to another, and it cannot be exchanged for anything other than the reward that shop has published.

The card is not a payment instrument, not stored value, and not a way of holding value.

You do not buy stamps with money. You earn them by visiting.

6. Redeeming your reward

When your card is full, show it to a staff member. They scan it in the shop's app, or enter their code on your card screen; the reward is handed over, and a new round begins.

A shop may run its card in stages: after a reward, the next round can ask for a different number of stamps and give a different reward, and after the last stage the card starts again from the first. Your card shows what comes after your current reward.

A shop may keep a stage's reward a surprise. Until you complete that stage your card shows "A big gift 🎁" instead of its name, and the reward you receive is the one the shop set for that stage when your round began.

A shop may also put gifts on some stamps. A gift is won when that stamp is collected at a branch the shop has chosen; at its other branches the stamp still counts, but the gift is not won. A shop may limit how many of a gift it gives, and while that limit is reached the gift is not won.

A gift you win waits on your card until a staff member hands it over, for as long as the shop allows; after that it lapses.

The code is entered by the staff member, not by you. If you are a staff member, do not give your code to a customer.

Redemption happens in the shop, during its opening hours. If the staff member enters their code on your phone rather than scanning your card, you will hand your phone over for a moment; they see your card screen and nothing else on your device.

A reward is handed over once per completed card.

7. If the shop changes its offer

A shop may change its reward or the number of stamps required. We require shops to make such a change going forward rather than to a round a customer has already started.

A card you have already started keeps the terms it started on. If a shop raises the number from 9 to 12 while your card is open, your card stays on 9 until you finish that round. The new number applies to your next round, not the one you are in.

The same is true of the reward itself, of its stages, and of stamps you have already earned: a later change does not reach back.

Stamps you have already earned are not cancelled by a later change. They do expire, though, if you stop using 9Pass altogether: if you collect no stamp at any shop for 24 months we close your account, and your stamps go with it. The privacy policy sets that out under how long we keep things.

8. If the shop leaves or closes

A shop may end its subscription, or close its doors. That is its decision, not ours.

Collecting stops straight away. Once a shop's subscription lapses and its grace period ends, a scan at that shop no longer adds a stamp. It does not keep working for a notice period, and we would rather you knew that here than at the counter.

A card that was already full stays redeemable for 30 days from when the shop stopped: we require a shop to honour those, and your card and balance stay visible to you throughout.

A card that was NOT full cannot be completed. There is no way to earn the last stamp, and we cannot give you the reward in its place. That is a real limit of this service.

We will tell you on your card page when a shop you hold a card with leaves, so the 30 days are yours to use rather than something you discover afterwards.

If a shop closes down entirely we cannot compel it to do anything. You may ask us at any time for the balance we hold, and we will give you a copy.

9. Fair use

Do not try to earn a stamp without a visit: by replaying an old stamp request, tampering with links, using someone else's account, or using a staff code that is not yours.

Do not try to read anyone else's data or to disrupt the service.

Most such attempts are refused by the system itself and logged. If we find deliberate abuse, we may suspend your account or cancel stamps that were not properly earned.

Before suspending an account we tell you why and give you a chance to reply, except where suspension is immediately necessary to protect the service or someone else's account. You may object to nine9pass@gmail.com.

10. Availability

We take reasonable care to keep the service running. We do not guarantee that it will not be interrupted.

It may go down for maintenance, for a failure at a provider we depend on, or for something outside our control.

An outage does not cost you stamps. Your balance is held with us and reappears when the service returns.

If a scan cannot go through, a staff member can add your stamp by hand afterwards. And if our service was down when you visited, tell us at nine9pass@gmail.com with the date and the shop and we will add the stamp ourselves.

11. The limits of our responsibility

We are responsible for the side we own: that the balance we hold is correct, that your card works, and that your information is protected as the privacy policy describes. If we get your balance wrong, we fix it.

We are not responsible for what the shop sells, its price, its quality, its opening hours, how its staff behave towards you in the shop, or its refusal to hand over a reward. That is about the shop's own conduct — what a staff member does with your data inside our app is our concern, and the privacy policy says who can see what.

We are not responsible for Apple Wallet, Google Wallet, your phone, or your connection.

We do not carry indirect losses, such as lost profit or lost time.

For direct harm we caused you, our total liability is limited to SAR 500. The limit is deliberately modest and definite: it is meant to cover what a stamp card can actually cost someone, and a limit that overreaches is one a court will not enforce.

This limit does not apply to fraud, to gross negligence, or to anything the law does not permit to be limited. Your right to complain to SDAIA, and your right to compensation for harm to your data, are statutory and are not taken away by this paragraph or any other.

12. Your data

What we collect, who sees it and how long we keep it is all in the privacy policy. Read it alongside these terms: it explains how we handle your information, and your rights over it come from the Personal Data Protection Law rather than from this contract.

In short: the shop and its staff see your name, your mobile number if we hold one, and your visit and stamp history there. They do not see your email or anything from another shop.

You may access, correct, delete and object, from your card page or by writing to nine9pass@gmail.com. Free, and within 30 days.

If you delete your account, your cards, stamps and unredeemed rewards are destroyed. We cannot bring them back, so redeem your reward before you delete.

13. Ending it

You may delete your account at any time and for no reason.

We may suspend your account if you break the fair-use section, after telling you, except in urgent cases.

We may discontinue the service entirely. If we do, we will tell shops and customers a reasonable time beforehand — at least 30 days where it is within our control — so you can redeem what you hold. If something outside our control stops the service sooner, such as a provider we depend on withdrawing, we will tell you as soon as we can.

These survive the end: the limits of our responsibility, the data provisions, and the governing law and jurisdiction.

14. Changes to these terms

We may update these terms. The date of the last update appears at the bottom of the page, and we keep previous versions.

If a change is material and affects you, we will announce it on your card page 30 days before it takes effect.

You may refuse. Tell us at nine9pass@gmail.com before the change takes effect and we will make sure you can redeem any full card first, then close your account. Continuing to use the service after the change takes effect is acceptance.

We do not change anything retroactively on a card you already have open.

15. Language, law, and jurisdiction

The Arabic version is the contract. The English is a translation provided for convenience, written to say the same thing, and if the two ever differ the Arabic governs.

They are governed by the law of the Kingdom of Saudi Arabia.

Jurisdiction lies with the competent Saudi courts.

Before going to court, write to us at nine9pass@gmail.com. Most of what reaches us is settled in writing.

If any clause is struck down as contrary to the law, the rest remain in force.
